1.1 These Terms and Conditions ("the Terms") govern the provision of music tuition services by Jordan W. McFarlane trading as McFarlane Music ("the Teacher", "we", "us" or "our").
1.2 By enrolling as a student or parent/guardian of a student, you agree to be bound by these Terms.
1.3 These Terms should be read in conjunction with the individual Lesson Agreement signed by or on behalf of each student.

2.3 The content, pace and structure of lessons are determined by the Teacher based on the student's level, goals, and progress. The Teacher reserves the right to adapt lesson content and teaching methods as appropriate.
3.1 Lesson durations are as agreed in the individual Lesson Agreement. Standard lesson lengths are 30 minutes, 45 minutes or 60 minutes.
3.2 Lessons are scheduled at mutually agreed times. Regular weekly lesson times will be allocated where possible.
3.3 The Teacher will make reasonable efforts to accommodate requests for alternative lesson times, subject to availability.
3.4 Lessons run in line with Telford & Wrekin school term dates unless otherwise agreed. There are no lessons during school holidays, bank holidays, or Teacher training days.
4.1 Lesson fees are as stated in the individual Lesson Agreement and are subject to annual review.

4.4 Invoices will be issued at the start of each payment period and are payable within 7 days of receipt.
4.5 Late payment may result in suspension of lessons until payment is received. A late payment fee of £10 may be applied to invoices unpaid after 14 days.
4.6 Fees are charged for the lesson slot held by the student, not for attendance. Students remain liable for fees during periods of absence except as provided in clause 5.
5.1 If a student is unable to attend a lesson, notice must be given as soon as possible.
5.2 Where notice of at least 24 hours is given, the Teacher will make reasonable efforts to offer a make-up lesson within the same term, subject to availability.
5.3 Where less than 24 hours' notice is given, or where the student fails to attend without notice, no refund or make-up lesson will be offered, and the full lesson fee remains payable.
5.4 The Teacher is under no obligation to provide make-up lessons and will do so only where practically possible. Make-up lessons not taken within the same term will be forfeited.
5.5 If the Teacher cancels a lesson for any reason, a make-up lesson will be offered at a mutually convenient time, or a pro-rata refund will be given if a make-up lesson cannot be scheduled.
5.6 In the event of Teacher illness or emergency, the Teacher will make reasonable efforts to provide notice as soon as possible.
6.1 Students (or parents/guardians on behalf of minor students) are responsible for:
6.2 For lessons at the Teacher's studio, students should arrive no more than 5 minutes before the scheduled lesson time and should be collected promptly at the end of the lesson.
6.3 Parents/guardians are responsible for the supervision of minor students before and after lessons. The Teacher does not provide childcare outside of lesson times.

7.2 The Teacher is not responsible for examination results, performance outcomes, or student progress beyond the provision of quality tuition. Progress depends significantly on consistent practice and student engagement.
8.1 Students must inform the Teacher of any medical conditions, allergies, or disabilities that may affect their learning or safety.
8.2 If a student or parent/guardian is unwell with a contagious illness, lessons should not be attended until the student is no longer contagious. Notice should be given in accordance with clause 5.
8.3 For lessons at the Teacher's studio, students and parents/guardians must follow any health and safety instructions provided.
8.4 The Teacher maintains public liability insurance and appropriate safeguarding measures in accordance with legal requirements.
9.1 The Teacher has an enhanced DBS check and follows safeguarding best practices in accordance with current legislation.
9.2 For lessons involving students under 18:
9.3 The Teacher reserves the right to refuse tuition or terminate the Lesson Agreement if there are concerns about safeguarding, behaviour, or the safety of the Teacher or other students.
10.1 Personal data provided by students and parents/guardians will be processed in accordance with UK GDPR and the Data Protection Act 2018.

10.3 This data is used solely for the purpose of providing tuition services and will not be shared with third parties except where required by law or with explicit consent.
10.4 Data will be retained for a maximum of 7 years after the end of tuition for accounting and legal purposes, after which it will be securely destroyed.
10.5 Students and parents/guardians have the right to request access to, correction of, or deletion of their personal data at any time.
11.1 The Teacher may, with permission, make audio or video recordings of lessons for educational purposes (e.g., to help students with practice or to demonstrate technique).
11.2 Students and parents/guardians will be asked for explicit consent before any recordings are made.
11.3 Students may record their own lessons for personal practice use only. Recordings must not be shared publicly or used for commercial purposes without the Teacher's written consent.
11.4 Where the Teacher creates bespoke learning materials, arrangements, or recordings for a student, copyright remains with the Teacher unless otherwise agreed in writing.
12.1 Where students wish to enter ABRSM or other music examinations, the Teacher will provide guidance and support.
12.2 The Teacher is not responsible for examination entry administration or fees. Parents/guardians are responsible for registering students for examinations and paying examination fees directly to the examination board.
12.3 The Teacher will advise when a student is ready for examination but cannot guarantee examination results.
12.4 Students may be invited to participate in recitals, concerts, or other performance opportunities. Participation is voluntary.
13.1 Either party may terminate the Lesson Agreement by giving four weeks' written notice.
13.2 The Teacher reserves the right to terminate the Lesson Agreement immediately without notice in cases of:
13.3 Upon termination, any fees paid in advance for lessons not taken will be refunded on a pro-rata basis.
14.1 The Teacher maintains public liability insurance.
14.2 The Teacher accepts no liability for loss or damage to students' personal property brought to lessons.
14.3 Students and parents/guardians attend lessons at their own risk. The Teacher's liability is limited to the provision of tuition services and does not extend to outcomes or results beyond the Teacher's direct control.
14.4 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for any other liability that cannot be excluded or limited by law.
15.1 The Teacher reserves the right to amend these Terms from time to time.
15.2 Students and parents/guardians will be given at least four weeks' notice of any material changes to these Terms.
15.3 Continued receipt of lessons after notice of changes constitutes acceptance of the amended Terms.
16.1 If you have a concern or complaint, please contact the Teacher directly in the first instance. We will make every effort to resolve matters informally and promptly.
16.2 If a complaint cannot be resolved informally, a formal written complaint may be submitted. The Teacher will respond within 14 days.
16.3 Any disputes arising from these Terms shall be resolved in accordance with the laws of England and Wales.
17.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The parties submit to the exclusive jurisdiction of the courts of England and Wales.
